By accessing or using the Contractor Qualifier Connect (“CQC,” “we,” “us,” or “our”) website or services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
2. Description of Service
CQC operates a qualifier network that connects licensed contractors willing to act as qualifying agents with construction companies that require a qualifying individual under applicable state law. CQC is not a staffing agency, employer, or payroll provider. CQC does not employ qualifiers, supervise construction activity, or control the work performed by any party. Any employment or engagement relationship formed as a result of a match is strictly between the company and the qualifier.
3. No License Renting
License renting, nominal qualification, or “paper qualifying” arrangements are expressly prohibited. All qualifiers matched through CQC must meet supervision and responsibility requirements imposed by applicable state law. CQC does not guarantee regulatory approval or licensing outcomes of any kind.
4. Fees
Qualifiers pay no fees to join the CQC network or to be matched with a company. Any fees applicable to companies seeking a qualifier are detailed separately in the applicable company service agreement.
5. State-Specific Compliance
Licensing requirements vary by state. CQC’s agreements incorporate state-specific addendums identifying the correct licensing authority, terminology, and employment requirements for each jurisdiction. It is the responsibility of the company and qualifier to ensure ongoing compliance with the laws of their state.
6. Replacement Policy
If a placed qualifier resigns or becomes unavailable within the agreed replacement period, CQC will use commercially reasonable efforts to identify a replacement qualifier, subject to availability and the terms of the applicable company agreement. Replacement is not guaranteed.
7. Qualifier Network Membership
Licensed contractors may join the CQC network provided they hold an active license in good standing and express interest in future qualifying opportunities. Membership does not guarantee placement.
8. No Guarantee of Outcomes
CQC does not guarantee that any company will be matched with a qualifier, that any qualifier will be placed, or that any licensing application will be approved. CQC’s role is limited to facilitating introductions between vetted parties.
9. Limitation of Liability
To the fullest extent permitted by law, CQC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to lost business, lost permits, or licensing delays.
10. Termination
CQC reserves the right to suspend or terminate access to its services for any user who violates these Terms & Conditions or engages in prohibited conduct, including attempts to rent, sell, or misuse licensing credentials.
11. Governing Law
These Terms & Conditions shall be governed by the laws of the state in which CQC is headquartered, without regard to conflict of law principles.
